Activity Indemnity and Safety Rules

Every adult participant accepts these rules individually before a guided trip, using the personal link sent to the main booking contact. A parent or legal guardian accepts for anyone aged 12 to 17.

1. The activity

Guided fly fishing with Ash River Outfitters, which may include fishing from a pontoon on a private section of the Ash River, walk-and-wade fishing (including wet wading) on the Ash River, Caledon River, Little Caledon River or other waters near Clarens, travel between the shop and the water, and associated instruction.

2. Inherent risks

Fishing takes place outdoors in a natural environment. Risks that cannot be completely removed include:

  • moving and deep water, currents and changing water levels;
  • slippery, uneven or unstable riverbeds, banks, rocks and pontoon surfaces;
  • slips, trips, falls and immersion in cold water;
  • hooks, flies, fly lines and rods, including injuries to the eyes and skin;
  • sudden changes in weather, lightning, heat, cold and sun exposure;
  • insects, snakes, livestock and other wildlife;
  • physical exertion and walking over rough terrain.

3. Health and disclosure

I confirm that I have disclosed any medical condition, physical limitation, mobility concern, medication or swimming ability that may be relevant to my safe participation, and that the information I provide is accurate. I understand that the guide may adapt, relocate or stop the activity for my safety.

4. Safety rules

  • I will follow the guide's instructions at all times, including instructions about where to stand, wade, cast and move.
  • I will wear a life jacket on the pontoon whenever the guide instructs, and use any other safety equipment required for the activity.
  • I will wear sunglasses or other suitable eye protection while casting or near other anglers who are casting.
  • I will consume alcohol only responsibly. The guide may refuse or stop my participation if alcohol, behaviour, health or any other factor creates a safety concern.
  • I will respect the fish, the water, private property and access rules. All fishing is strictly catch and release.
  • I remain responsible for my personal belongings.

5. Acceptance of risk

I understand the inherent risks described above and choose to participate voluntarily. To the extent permitted by law, I accept responsibility for injury, loss or damage arising from those inherent risks or from my failure to follow the guide's instructions.

6. Your rights are preserved

Nothing in this document excludes or limits any liability of Ash River Outfitters for gross negligence, or any liability or consumer right that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or other South African law.

7. Minors

The minimum age is 12. For a participant under 18, a parent or legal guardian must complete this acceptance on the minor's behalf, and a responsible adult must accompany the minor throughout the activity.

8. Photographs

Accepting these terms does not give permission to use my photograph for marketing. Ash River Outfitters will ask separately after the trip.
